Terms of Service

1. Agreement to Terms

By accessing or using the TMH Group Platform Access Portal (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform.

2. Description of Service

TMH Group operates a compliance-first, role-separated access platform for insurance coordination. The Platform facilitates onboarding and routing for brokers and employers across multiple entities:

• TMH Group provides public-facing access and routing. TMH Group does not provide insurance, does not discuss pricing or compensation, and does not act as a plan sponsor or fiduciary.
• Millennial Insurance Group (MIG) is the licensed general agency and compliance bridge that administers access-fee pricing tiers and platform advisor revenue structures.
• UB Insurance Agency is the licensed producer responsible for insurance education and enrollment.
• UB TPA handles all ACH, payment, and premium remittance.

3. User Accounts & Eligibility

The Platform serves three types of users:

• Platform Advisors: Licensed professionals who complete onboarding to coordinate with MIG and access advisor-specific workflows.
• Platform Access Organizations: Businesses that register to participate in benefits coordination platforms on behalf of their members.
• Administrators: Authorized TMH Group personnel who manage the Platform.

By registering, you represent that the information you provide is accurate and complete, and you agree to keep it updated.

4. Acceptable Use

You agree to use the Platform only for its intended purposes and in compliance with all applicable laws and regulations. You agree not to:

• Provide false, inaccurate, or misleading information.
• Use the Platform for any unlawful purpose or in violation of insurance regulations.
• Attempt to gain unauthorized access to any portion of the Platform or its systems.
• Interfere with or disrupt the Platform or servers connected to it.
• Reproduce, modify, or distribute any content from the Platform without authorization.

5. Intellectual Property

All content, trademarks, logos, and intellectual property displayed on the Platform are the property of TMH Group or its licensors. You may not use, reproduce, or distribute any content from the Platform without prior written consent.

6. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied.

Important disclaimers:

• TMH Group does not provide insurance products or services.
• TMH Group does not act as a plan sponsor, fiduciary, or insurance advisor.
• All insurance services are provided by appropriately licensed agencies (UB Insurance Agency).
• Employer participation in any insurance arrangement is voluntary and member-initiated.
• TMH Group makes no representations regarding insurance coverage, benefits, or outcomes.

7. Limitation of Liability

To the fullest extent permitted by law, TMH Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

8. Third-Party Services

The Platform integrates with third-party services to provide its functionality. These include:

• Supabase: Database hosting and authentication services.
• UB TPA: ACH payment processing and premium remittance. All banking information is collected and stored exclusively by UB TPA.
• Millennial Insurance Group (MIG): Platform advisor agreement and tier management.

Your use of third-party services is subject to their respective terms and privacy policies. TMH Group is not responsible for the practices of third-party service providers.

9. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination will remain in effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Texas.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
